Use of Site
www.newgateworld.com is available to access, browse and for placing orders in accordance with the following Terms and Conditions. Prior to placing an order on newgateworld.com you will be required to agree that you have read these Terms and Condition of Sale. Please read these carefully.


Ability to Accept Terms of Use
To place an order, you must be legally capable of agreeing to a binding contract. Children under the age of 18 are not authorised to place an order on this site and we request that you please do not submit any personal information to us.


Intellectual Property & Content
We have many measures in place to protect Newgate’s products, designs and content, including close association with a renowned firm of lawyers that handle any copyright infringement cases on behalf of Newgate. This includes, but is not limited to, products and design, images, photographs, logos, products, website content and stylised names. It is strictly prohibited to copy, republish or redistribute any content and materials without prior authorisation from Newgate.

Newgate reserve the right, at any time, to withdraw any such authorisation without liability to you for any reason.

Where user content has been posted on Social Media platforms using a hashtag or tagging or mentioning NewgateWorld, we reserve the right to re-post these images on the platform that they were posted, giving credit to the original creator. Content on newgateworld.com, including descriptions, information and imagery, is created to assist customers. We aim to make this information as accurate as possible, but cannot guarantee that information will be entirely without difference to the actual product. Any typographical errors identified will be amended as soon as possible. We work very hard to ensure that our product images are as accurate a representation of the product as possible, but some variation may occur. All display screens and computer monitors display colours slightly differently, so although we try to match colours as closely as possible, the colour that you see on screen may vary from the actual product colour.


Availability of Products
Our website contains live data and is updated regularly. However, there may be occasions where a product that you have viewed and ordered through our website maybe incorrectly listed or unavailable at the time of order. After you have placed your order and this has been acknowledged, you will receive a further email to confirm availability and order acceptance.


Promotional & Discount Codes
All promotional or discount codes are subject to their own terms and restrictions. They must be used in the manner intended when issued for use and must not be sold, passed on or made public. They may be disabled at any time without prior warning, without liability to us, and may expire prior to your use.


Payment
Payment can be made 24 hours a day online using our secure credit card payment facility. We accept MasterCard or Visa card payments. Prices listed on this website include VAT. Prices are subject to change which can happen at any time.

Any cost of postage and packaging will be listed separately.

Order placement and subsequent acknowledgement email are not acceptance of an order, just confirmation that the online request has been received. Newgate reserve the right to withdraw any sale. This may be, but is not limited to, the following reasons:

  • Payment is declined
  • Pricing was incorrect
  • Delivery address incorrect
  • Order is identified as fraudulent or unusual by our security systems
  • A violation of these terms and conditions has been deemed
  • An order is deemed to be from a reseller or unauthorised party
  • Or for any other legitimate reason

Newgate reserve the right to request further information where additional checks are required in order to fulfil the order and cannot be liable for any damages or costs occurred as a result of refusing or delaying an order.


Changes To An Order
If you need to make any changes to your order after it has been placed please contact us as soon as possible at hello@newgateworld.com or call us on +44 1691 679994. Once we have processed your order unfortunately we will no longer be able to make any changes.


Cancelling An Order
Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any of our products within a period of 14 days, beginning on the day the item is delivered. If you wish to cancel an order please advise us of your desire to do so by emailing hello@newgateworld.com and including your full name and order number, or return your items via the method detailed in our returns policy. After notifying us of your wish to cancel an order you have 14 days to return the order to us. Unfortunately, we are not able to cover return postage. We recommend you obtain proof of postage when sending an item through the post, as we are not responsible for items which fail to reach us.

International Access
Newgateworld.com can be accessed from around the world and may feature products and services which are not available in every country that it may be viewed in. Shipping costs may vary and in some locations may not be possible.


Import Duties and Taxes
We ship to selected countries outside of the EU on a Delivery Duty Unpaid basis. This means the recipient will be responsible for any local sales taxes or import duties which may be charged on the purchase.

Please note taxes and duties are not applicable for USA orders under 1000 USD and Australian orders under 1000 AUD.

Newgateworld.com requires users to comply and be responsible with their own local law when using this site.

Newgate warrants, subject to these conditions, that on delivery, the Goods shall be of satisfactory quality within the meaning of the Sale of Goods Act 1979 and reasonably fit for purpose. These warranties are given in lieu and exclude the operation of the implied terms as to satisfactory quality and fitness for purpose in the Sale of Goods Act 1979, to the fullest extent permitted by law. Newgate shall not be liable for a breach of any of the above warranties unless you give written notice of the defect to Newgate within 14 days of when you discover or ought to have discovered it, whichever is the earlier, and (if asked to do so by Newgate) you return such Goods to Newgate.

Newgate shall not be liable for a breach of any of the above warranties if you make any further use of the Goods after giving such notice or a defect, or the defect arises because you have failed to follow Newgate's oral or written instructions as to the storage, installation, use or maintenance of the Goods or (if there are none) good practice, or if you carry out any repairs or bring about changes in the Goods, or if the Goods delivered are used improperly or for any purpose other than that for which they are meant. Subject to the above, if any of the Goods do not conform to the warranties given, Newgate shall, at its option, replace these Goods (or the defective part) or refund the price of those Goods to you.

If Newgate replaces or refunds the Goods as stated above, it shall have no further liability for a breach of any of the warranties given in respect of such Goods and any Goods replaced or returned shall belong to Newgate. Please call our customer service team 01691 679994 to discuss any defects in or returns of Goods and to obtain an official Newgate returns authorisation code, prior to returning any Goods. If you fail to obtain an official Newgate returns authorisation code, a refund or replacement may not be issued for any Goods returned.

The Goods are at your risk from the time of delivery. Where applicable, risk in transit shall remain with Newgate provided that, in the event of any damage to the Goods during transit, Newgate will only replace damaged Goods it is satisfied that the damage has occurred in transit, and subject to having received notice in writing from you within 48 hours of delivery, describing the damage to the Goods.


Limitation of Liability
The following conditions set out the entire financial liability of Newgate (including any liability for the acts or omissions of its employees, agents and subcontractors) to you respect of any breach of these conditions, any use made or resale of the Goods and any representation, statement or act or omission in connection with the Contract. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract.

Nothing in these conditions excludes or limits the liability of Newgate for death or personal injury caused by Newgate's negligence or for any matter which it would be illegal to attempt to exclude its liability or for fraud or fraudulent misrepresentation.

Subject to the above, Newgate's total liability in contract, tort, misrepresentation, restitution or otherwise, arising in connection with the Contract shall be limited to the price of any Goods supplied to you or the sum of [£50,000] (whichever is the greater).

Where you are not satisfied with our response to a complaint, any dispute, and these Terms and Conditions, shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

WEEE Directive
You can now recycle your old electricals with us. If you're buying a new electrical item, we will recycle your old one for free. Please contact us at hello@newgateworld.com with any queries.

Why Recycle?
Unwanted electrical equipment is the UKs fastest growing type of waste. Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.

We Can Help
We are pleased to offer our customers the chance to recycle their old electrical items when purchasing a new item from us. Please speak to a member of staff for details on how to dispose of your WEEE item. To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin.

What is WEEE?
The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.
